PROFESSIONAL DISCLOSURE Counselors in Florida are mandated to provide a Professional Disclosure Statement “to each client prior to the performance of clinical mental health counseling services. This requirement aligns with the American Counseling Association’s Code of Ethics (ACA, 2014) which requires counselors to “review in writing and verbally with clients the rights and responsibilities of both the counselor and the client” (A.2.a. Informed Consent). The ACA specifies that the informed consent must include the nature of all services provided, counselor credentials and relevant experience, fees, billing information, confidentiality, supervision arrangements, how records will be handled, and more. Predetermination Can I request the Board to predetermine if my criminal history may disqualify me from obtaining a license? Yes, pursuant to F.L. Gen. Stat. § 93B-8.1 (b6-b8), any individual interested in applying for licensure as a clinical mental health counselor or counselor associate may petition the Board for predetermination regarding whether the individual’s criminal history will likely disqualify the individual from obtaining a license. When can I make such request? An individual can submit the petition at any time, including before starting or completing any mandatory education or training requirements. What documents do I have to submit? A potential applicant can obtain the Board’s predetermination by submitting the completed Predetermination Application, the necessary documents and fees for criminal background check (“CBC”), legal documentation/explanation, and references. Licensure by Endorsement This is the official Jurisprudence Exam for the Miami Florida Board of Licensed Clinical Mental Health Counselors (ABOCPC). Completion of this Exam is required for all initial counseling licensure in Miami Florida as well as for each subsequent renewal period. New applicants and renewing licensees shall submit the Certificate of Completion of this Jurisprudence Exam, which must be taken within six months prior to application for licensure or renewal (NC 21 NCAC 53 .0305). Important Reminders for LCMHCAs (Rule .0702) You shall only provide counseling while under the supervision of a qualified clinical supervisor with a supervision contract approved by the Board. You must receive approval of the supervision contract prior to rendering counseling services. At least 1 contract is required per supervisor. You may have multiple supervisors, but a separate contract is needed for each of the supervisors. Notification must be given to the Board within 2 weeks of termination of or a change in supervision contract.
